Criminal law counteraction to the use and (or) transfer of personal data by organizers of illegal gambling on the Internet

In light of recent changes in criminal and administrative legislation affecting the area of ensuring the security of personal information of citizens of the Russian Federation, the issue of using personal data of organizers of illegal gambling on the Internet has acquired new facets for research. With the help of information and telecommunication technologies, the process of processing, accumulating and transferring personal data is simplified many times over, and online casino participants often do not suspect that their consent to enter into a gambling game allows the owners of such a gambling business to illegally process information about players, which in most cases is of a personal nature. These circumstances suggest the need to conduct a theoretical and applied criminal-legal study of social relations that develop during the illegal use and (or) transfer of personal data by organizers of online gambling.
The article is devoted to the study of the current state of criminal law counteraction to the use and (or) transfer of personal data by organizers of illegal gambling on the Internet. The provision of article 2721 of the Criminal Code of the Russian Federation is critically analyzed, problems arising in the course of law enforcement practice are identified, the possible qualification of the criminal acts in question is determined, as well as their consequences in accordance with the current criminal legislation and measures of criminal law counteraction to them. It is concluded that it is necessary to improve the mechanism of criminal law counteraction to the use and (or) transfer of personal data by organizers of illegal gambling on the Internet, namely in clarifying and correcting the objective side of criminal acts provided for in parts 1 and 6 of Article 2721 of the Criminal Code of the Russian Federation. In addition, it has been established that information about online casino players can be used for various criminal purposes, which requires additional assessment and qualification.
