Features of the Seizure of Land Plots and (or) Real Estate Objects Located on Them for State Needs in the Territories of Advanced Development of the Far East

Abstract

Тhe article is devoted to the study of the features of the seizure from the owners of land plots and (or) real estate objects located on them for state needs in order to accommodate infrastructure facilities in the territories of advanced development of the Far East. Based on the data presented in the annual reports of the Far East Development Corporation, the author analyzes the main performance indicators of twenty-two territories of advanced development of the Far East, according to which the effectiveness of the functioning of these territories has been proven in dynamics. The regulatory and legal framework related to the seizure of land plots and (or) real estate objects located on them is also considered for state needs in order to accommodate infrastructure facilities in the territories of advanced development of the Far East, as well as various information materials on this issue in the media have been analyzed. In order to determine the problems during the seizure, the materials of the judicial practice published in the ConsultantPlus reference legal system for resolving disputes related to the seizure of land plots and (or) real estate objects located on them for state needs in order to accommodate infrastructure facilities of the territories of advanced development of the Far East were studied. Based on the results obtained, the author identified the main problem during the seizure, which consists in the presence of a significant number of disputes about the amount of the purchase price of seized land plots and (or) real estate objects located on them, and also proposed a solution to it, which will increase the confidence of property owners in the authorities performing the seizure and reduce the number of litigation related to with the size of the purchase price.
