This article is devoted to the legal problems that exist in the Russian Federation associated with the establishment of motherhood or paternity in the application of surrogacy methods. Today, for various reasons, this institution is gaining more and more popularity, and the legislation in this area has not been improved for a long time. Because of this, we consider it necessary to draw the attention of the legislator to the existing legal imperfections and offer some ways to improve the system of the institution of surrogate motherhood in order not only to simplify the procedure, but also to legally regulate it, thereby securing the participants in such legal relations in the field of protecting their rights.
