Abstract

The article addresses the problem of doctrinal development of the concept of lands intended for burial. Based on the typical approach for the formal-logical procedure of definition, a set of generic concepts supplemented by specific characteristics of burial grounds is considered. The article identifies two types of problems solved by the category of lands under consideration. Satisfaction of the spiritual and religious needs of the population in the organization of places of burial of deceased loved ones pursues the solution of non-utilitarian tasks. At the same time, ensuring the sanitary and epidemiological safety of settlements from the penetration of toxic chemicals from burial sites indicates the existence of purely utilitarian tasks of these lands. The set of specific characteristics disclosed in the current legislation and legal doctrine of the Russian Federation allows us to offer the author's understanding of the concept of lands intended for burial. The proposed concept can serve as a basis for changing land legislation.
